Manslaughter charges in Florida
Manslaughter is voluntary or involuntary unlawful killing of a human being without malice. The main difference between manslaughter and murder is that manslaughter is the result of an accident, act of passion, or some other act in which the person does not have the mental state to commit a murder.
Manslaughter is a serious charge but is a lesser degree of severity than homicide or felony murder. The main thought behind the lesser consequences is the assumption that the defendant did not intent to kill. Some examples of manslaughter may include drunk driving accidents, crimes of passion and other such situations.
There are 3 main variations of manslaughter:
- Vehicular Manslaughter - when person drives a vehicle and unintentionally but unlawfully kills another human being. This occurs when the owner knows that there is a defect in the vehicle but still drives and someone is killed as a result of the defect in the vehicle.
- Voluntary Manslaughter - When a person kills another in the heat of passion without any forethought.
- Aggravated manslaughter is an enhanced charge that is applicable in certain situations. This may include the death of an elderly person, causing the death of someone under 18, causing the death of a fire or resume personnel. This charge is a first-degree felony punishable by life imprisonment
